Conditions of Participation
Binding Conditions of Participation for the BLOOOM Award by WARSTEINER 2011 for participants from the Netherlands
I) Participation:
The BLOOOM Award by WARSTEINER is intended for young creative people, artists and artist groups, etc. Anyone who is at least 18 years of age and lives in the Netherlands may participate. In cases of doubt, the respective participants are responsible for providing evidence of their age and place of residence.
Personal information must be accurate; providing false information can disqualify the participant(s). The participants are responsible for the accuracy of the data provided.
Participation takes place online at www.blooomaward.de; applications can be submitted until July 31, 2011 at 11:59 pm.
A registration screen must be filled in with the following information and data:
- Contact information for the participant(s)
- Information about the work submitted, including max. 100 words about its creation, in English
- A CV for the artist(s), in English
- The submission itself as a jpg (at least 300 dpi), pdf or Vimeo/YouTube link
The maximum upload size is 20 MB.

Only one submission is permitted per applicant / applicant group (no series).
The work cannot be more than two years old.
Submitting ineligible work will automatically disqualify the respective participant(s).
Please note that for joint submissions by multiple artists, only the communications between the main contact partner named by the group and the organizers of the competition will be decisive.
There is no fundamental entitlement to participate in the BLOOOM Award by WARSTEINER. Therefore Warsteiner International KG is not required to provide further information when refusing applications. The participants also have the option not to participate.
There will be extensive media coverage of the BLOOOM Award by WARSTEINER – even before the finale. This gives the participants the opportunity to reach a broad, interested audience with their work. By submitting the application materials, the participants agree to the free publication of their work, CVs and possibly portraits (if requested), and in some cases their place of residence, age and project description on the website www.blooomaward.de, in the BLOOOM area of ART.FAIR | Fair for modern and contemporary art 2011, in the online and printed materials for PR work at the BLOOOM exhibition platform and the ART.FAIR, as well as in all other advertising for the BLOOOM Award by WARSTEINER. Participants should also be available for interviews if requested.
By applying for the BLOOOM Award by WARSTEINER, every participant / participant group declares that the submitted work is an individual piece (series are not permitted) that was designed and created by the participant(s), and that they own all rights to this work. In addition, if people’s images are reproduced in the work, the competitor(s) must have obtained releases from these people and must provide such releases to Warsteiner International KG upon request in writing.
Furthermore, the participants guarantee that the work does not reproduce or otherwise use any copyright-protected works. In addition, the work cannot have been based on a third party’s artwork.
The participants hereby release Warsteiner International KG from any and all third-party claims.
II) Jury & competition:
A jury of experts (for the current members of the jury, see www.blooomaward.de) will choose the “Dutch Winner of BLOOOM Award by WARSTEINER” from among all of the Dutch participants. The participants will immediately be notified of the jury’s decisions.
The “Dutch Winner of BLOOOM Award by WARSTEINER” will be presented on the website www.blooomaward.de as well as in the BLOOOM area of ART.FAIR | Fair for modern and contemporary art 2011 in Cologne, Germany, and where applicable in the online and printed materials for PR work. The award ceremony will take place during BLOOOM, as part of ART.FAIR | Fair for modern and contemporary art 2011. Beside the presentation of his submitted artwork in the special exhibition of BLOOOM Award by WARSTEINER at BLOOOM, the “Dutch Winner of BLOOOM Award by WARSTEINER” will receive one year of mentoring support from a Dutch mentor as well as a trip to Miami to attend Art Basel Miami Beach in 2011 or 2012, as preferred.
The jury’s decision is binding. Recourse to legal proceedings is excluded.
The competition will end on November 1, 2011 during BLOOOM at ART.FAIR | Fair for modern and contemporary art.
The BLOOOM Award by WARSTEINER will provide support for the “Dutch Winner of BLOOOM Award by WARSTEINER” in the form of a flat compensation fee of €150 for travel and accommodations. If the “Dutch Winner of BLOOOM Award by WARSTEINER” is an artist group with at least two members, the flat rate will be increased to €300 regardless of the number of people in the group.
The prize cannot be paid in cash. The prize must be claimed by the “Dutch Winner of BLOOOM Award by WARSTEINER” within one year. In deviation from this rule, the Art Basel Miami Beach event can be attended in either 2011 or 2012. Otherwise, the claim to the prize will be rendered invalid. Recourse to legal proceedings is excluded.
III) Data protection:
Warsteiner International KG agrees to observe and apply the legal data-protection regulations and to preserve the secrecy of telecommunications.
Participants’ personal data will exclusively be stored for the purpose and for the duration of the competition (including the exhibition, the preliminary report and the follow-up report) and will be treated as confidential. In the course of the selection process, this data will be shared with the jury members and organizers. The participants agree to be identified by name and in some cases by CV, portrait, age and place of residence when the work and its description are made public.
After the end of the BLOOOM Award by WARSTEINER, all of the information provided by participants will be deleted. The contact data for participants who also subscribed to a newsletter during the application process will continue to be stored exclusively for this purpose, unless the newsletter is cancelled by email (award-info@blooom.de) or online at www.blooomaward.de.
Furthermore, participants have the option of withdrawing the permission to store their data; such withdrawal will simultaneously be considered a withdrawal from participation. Permission can be withdrawn electronically by sending a message to award@blooom.de.
The application for and participation in the BLOOOM Award by WARSTEINER, the selection procedure and all other legal interactions associated with participating in this competition are exclusively based on the legal provisions of the Federal Republic of Germany. These are subject only to German law and the German understanding of the law. Where permissible, the place of jurisdiction shall be Cologne, Germany.
The English version of these Conditions of Participation is to be used for informational purposes only. In the event that the English version deviates in terms of its meaning or literal sense, only the German version shall be considered definitive.
